By accessing or using NextAge websites, applications, and services (“Services”), you agree to these Terms. If you do not agree, please do not use the Services.

1) Eligibility & Acceptable Use

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.
  • You agree not to use the Services for any unlawful, harmful, or disruptive activity (including security breaches, fraud, IP infringement, or spam).
  • We may monitor usage to maintain security, integrity, and service quality.

2) Accounts & Security

  • You’re responsible for the accuracy of information you provide and for safeguarding any credentials.
  • Notify us immediately of unauthorized access or suspected security incidents.
  • We may require identity verification for sensitive actions.

3) Intellectual Property

All content, code, designs, trademarks, logos, and materials on or produced by the Services are owned by NextAge or its licensors. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works without prior written consent.

Project-specific IP ownership and licensing (e.g., source code, assets, deliverables) will be governed by the applicable proposal, Statement of Work (SOW), Master Services Agreement (MSA), or similar contract between you and NextAge.

4) Proposals, Orders & Payment

  • Service scope, timelines, and fees are defined in proposals or SOWs accepted by the client.
  • Invoices are due as stated (e.g., milestones, retainers); late payment may result in suspension or late fees.
  • Expenses approved by the client (e.g., licenses, cloud usage) will be invoiced accordingly.
  • Change requests may affect scope, budget, and timelines and will require written approval.

5) Warranties & Disclaimers

Unless otherwise stated in a signed agreement, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory (including merchantability, fitness for a particular purpose, and non-infringement).

We do not guarantee uninterrupted or error-free operation, nor that defects will be corrected, though we strive for reliability and quality.

6) Limitation of Liability

To the maximum extent permitted by law, NextAge shall not be liable for indirect, incidental, special, consequential, or exemplary damages, including lost profits, loss of data, or business interruption. Our aggregate liability under these Terms is limited to the amounts you paid for the specific Service giving rise to the claim in the 3 months preceding the event.

7) Third-Party Services

The Services may integrate or rely on third-party platforms or suppliers. We are not responsible for third-party availability, performance, or terms, and your use of them is governed by their policies.

8) Suspension & Termination

  • We may suspend or terminate access for violations of these Terms, security risks, or non-payment.
  • You may cease use at any time; contractual obligations in signed agreements (e.g., fees due) will still apply.
  • Upon termination, your right to use the Services ceases; some provisions (e.g., IP, confidentiality, payment, liability) survive termination.

9) Governing Law & Disputes

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules. Disputes will be subject to the exclusive jurisdiction and venue of competent courts in Pakistan.

10) Changes to Terms

We may update these Terms from time to time. The “Effective date” above indicates the latest revision. Continued use after changes constitutes acceptance.
